Then came the sentence worth remembering. Because the plan said nothing about the cost of recovery, the common fund doctrine filled that gap as the default rule for attorney fees. Silence helps the claimant; explicit drafting does not.

If Medicare paid any of it

A federal formula, not a negotiation, sets the reduction. Under 42 CFR 411.37, where Medicare paid less than the settlement, the ratio of procurement costs to the total settlement is applied to the Medicare payment, and that share of costs is subtracted from what Medicare recovers. Where the payments equal or exceed the settlement, recovery is the settlement minus total procurement costs. The calendar is unforgiving. The recovery contractor issues a conditional payment letter within 65 days of the rights and responsibilities letter, and a conditional payment notice must be answered within 30 calendar days or a demand issues without any reduction for fees or costs. Disputes take 45 days, interest runs from the demand, and referral to the Treasury follows 150 days after it.
